1. Wstęp
Podatek akcyzowy jako selektywny podatek obrotowy stanowi, obok podatku od wartości dodanej, jedną z podstawowych konstrukcji w zakresie opodatkowania konsumpcji w większości współczesnych, wysoko rozwiniętych państw. Jak wiadomo, potrzeba wprowadzenia wspólnotowych regulacji w zakresie akcyz pojawiła się w związku z utworzeniem, z dniem 1 stycznia 1993 r., wspólnego rynku oraz likwidacją granic fiskalnych i celnych pomiędzy państwami członkowskimi. Ponadto wypada podkreślić, że obecnie, na skutek postępującej globalizacji oraz gwałtownego rozwoju handlu międzynarodowego, szczególnego znaczenia nabierają kwestie związane z transgranicznymi aspektami opodatkowania obrotu. W związku z powyższym wszelkie zmiany w sferze krajowych konstrukcji podatku akcyzowego oraz podatku od towarów i usług muszą być zgodne nie tylko z przepisami Konstytucji RP oraz normami prawa wspólnotowego, ale powinny także uwzględniać międzynarodowy kontekst transakcji, tj. założenia przyjmowane w innych państwach, w tym również spoza Unii Europejskiej. Oznacza to, że projektując nowelizacje przepisów prawa polskiego należy uwzględnić zarówno normatywny kontekst regulacji oraz ograniczenia wynikające z ustawy zasadniczej i przepisów prawa europejskiego, jak i przyjęte na szczeblu międzynarodowym założenia dotyczące zasad funkcjonowania systemu opodatkowania konsumpcji. Istotne znaczenie mają również uwarunkowania natury politycznej oraz gospodarczej, w szczególności konieczność realizacji podstawowych funkcji państwa w dobie kryzysu finansowego oraz potrzeba dostosowania regulacji prawnych do zmieniających się na skutek postępu technologicznego możliwości dokonywania transakcji.
Podstawowym celem niniejszego artykułu jest przedstawienie projektowanych scenariuszy zmian w zakresie podatku akcyzowego oraz uwarunkowań i ograniczeń jakie wiążą się z tymi zmianami. Z uwagi na rozmiar opracowania uwzględniono jedynie wybrane założenia dotyczące poziomu opodatkowania poszczególnych wyrobów akcyzowych. Pominięte zostały natomiast kwestie związane z organizacją obrotu wyrobami akcyzowymi .

1. Introduction
Excise duty, being a selective turnover tax, is, along with value-added tax, one of the basic constructs for the taxation of consumption in most modern, highly-developed countries. As is commonly known, the need to introduce Community regulations on excises appeared in connection with the establishment, as of 1 January 1993, of the Single Market and the abolition of fiscal and customs borders between Member States. It should also be emphasised that at present, as a result of growing globalisation and the rapid development of international trade, the issues related to the cross-border aspects of turnover taxation are becoming particularly prominent. Consequently, any changes in the sphere of the domestic structures of excise duty and value-added tax do not only have to be compatible with the provisions of the Constitution of the Republic of Poland and the norms of Community law but should also take into account the international context of transactions, i.e. the assumptions adopted in other countries, and also outside the European Union. Therefore, drafting amendments to the provisions of Polish law requires taking into account both the normative context of the regulations and the restrictions resulting from Polish Constitutional Law and the provisions of European law, and the assumptions adopted at the international level, behind the principles of how the system of consumption taxation works. Factors of a political and economic nature are also significant, in particular the necessity to fulfil the basic functions of the State during the time of the economic crisis, as well as to adjust the legal regulations to the available means of conducting transactions that change due to technological progress.
The primary aim of this article is to present the proposed change scenarios for excise duty and the factors and restrictions involved in these changes. Due to the length of the article, only selected assumptions behind the taxation level of individual excise products have been taken into consideration. It does not discuss issues related to the organisation of the trade in excise products.

Source text - English Self tapping screws are designed in such a way that once a pilot hole is drilled into bone they can be inserted by simply screwing them in. The pilot hole is somewhat larger than the core of the screw. Because the screw has to cut its own thread as it is inserted, it encounters considerable resistance, particularly in thick cortical bone. At times the resistance may be such that the torque required to drive the screw in is greater than the tolerance of the screw and the screw may break. In addition, the resistance to screw insertion may interfere with the accuracy of insertion, particularly if one is trying to insert the screw obliquely into bone to lag two fragments together. It used to be thought that self tapping screws had a weaker hold in bone. Experimental investigation (Schatzker et al. 1975) has shown that a self tapping screw can be removed and reinserted without weakening its hold in bone provided it is carefully inserted. However, if inadvertently angled it will cut a new path and destroy the already cut thread, which is a disadvantage.
Non self tapping screws require a predrilled pilot hole and then a careful cutting of their thread in cortical bone with a tap, which corresponds exactly to the profile of the screw thread. Because the thread is cut with a tap the pilot hole corresponds in size almost to the core of the screw and the screw thread has a much deeper bite into the adjacent bone. Because of less resistance when inserting the screw there is much less heat generated. The tap is designed in such a way that it is not only much sharper than the thread of a screw, but it also has a more efficient mechanism of clearing the bone debris, which therefore does not accumulate and clog its threads to obstruct its insertion. This allows one to work with much greater precision, particularly in thick cortical bone.
The screws can be removed and reinserted with ease without the fear of inadvertently cutting a new channel, as a screw alone is not able to cut a channel in cortical bone.
Translation - Polish Śruby samogwintujące zaprojektowane są w ten sposób, że po wywierceniu otworu prowadzącego można je umieścić bezpośrednio przez wkręcanie. Otwór prowadzący jest nieco większy niż trzpień śruby. Ponieważ śruba musi sama naciąć gwint w trakcie wkręcania, napotyka ona znaczny opór, szczególnie w gęstej kości korowej. Czasami opór jest tak duży, że moment obrotowy konieczny do wkręcenia śruby przekracza wytrzymałość śruby i może ona pęknąć. Opór ten może również wpływać na dokładność wkręcania, w szczególności, gdy śrubę próbuje umieścić się w kości skośnie, aby złączyć jej dwa fragmenty przez dociśnięcie. Uważano kiedyś, że śruby samogwintu-jące słabiej trzymają się w kości. Badania doświadczalne (Schatzker et al. 1975a) pokazały, że śruba samogwintująca może być wykręcona i ponownie wkręcona bez osłabienia połączenia, pod warunkiem jej bardzo ostrożnego wkręcania. Śruby zwykłe wymagają wcześniejszego wywiercenia otworu i następnie dokładnego nacięcia gwintu w kości korowej przy pomocy gwintownika, który odpowiada dokładnie profilowi gwintu śruby. Gwint nacinany jest przy pomocy gwintownika, więc otwór prowadzący odpowiada swoim rozmiarem niemal dokładnie rozmiarowi trzpienia śruby, a gwint znacznie głębiej penetruje kość. Z powodu mniejszego oporu w trakcie wkręcania generowane jest znacznie mniej ciepła. Gwintownik posiada taka konstrukcję, że jest nie tylko dużo ostrzejszy od gwintu śruby, ale rów-nież zapewnia bardziej wydajny mechanizm usuwania pozostałości kości, które dzięki temu nie kumulują się i nie zapychają gwintu śruby utrudniając jej wkręcanie. Umoż-liwia to pracę ze znacznie większą precyzją, szczególnie w gęstej kości korowej.
Śruby takie można z łatwością usuwać i ponownie wkręcać bez obawy, że przez nieuwagę wytnie się nowy zarys gwintu, ponieważ sama śruba nie może wyciąć gwintu w kości korowej.
