Source text - English 9.1.3 THIRD PARTY
i) SUPPLIER shall defend, indemnify and hold harmless COMPANY GROUP from and against any CLAIM in respect of damage to, or loss of THIRD PARTY’s property and equipment, including CONSEQUENTIAL LOSS and personal and bodily injury including death, sickness or disease of any THIRD PARTY, caused by SUPPLIER GROUP or SUPPLIER GROUP’s property and equipment, and arising out or in relating to the performance, mis-performance or non-performance of the CONTRACT.
ii) COMPANY shall defend, indemnify and hold harmless SUPPLIER GROUP from and against any CLAIM in respect of damage to, or loss of THIRD PARTY’s property and equipment, including CONSEQUENTIAL LOSS and personal and bodily injury including death, sickness or disease of any THIRD PARTY, caused by COMPANY GROUP or COMPANY GROUP’s property and equipment, and arising out of, or relating to the performance, mis-performance or non-performance of the CONTRACT.
9.2 Waivers of recourse
i) SUPPLIER waives all rights of recourse against and shall defend, indemnify and hold harmless COMPANY GROUP from and against any CLAIM in respect of loss of or damage to SUPPLIER GROUP’s property and equipment.
ii) Subject to the provisions of article 9.1.2, COMPANY waives all rights of recourse against and shall defend, indemnify and hold harmless SUPPLIER GROUP from and against any CLAIM in respect of loss of or damage to COMPANY GROUP’s property and equipment.
10. Holding Harmless
Waivers of recourse, exclusions and indemnities given under the CONTRACT shall apply irrespective of cause and notwithstanding the negligence, breach of duty (statutory or otherwise) or other failure of any nature the indemnified GROUP and shall apply irrespective of any CLAIM in tort, contract or otherwise at law. All indemnities under the CONTRACT shall be full and primary and shall be enforceable irrespective any separate right of indemnity or contribution from any PERSON unless otherwise provided for herein. Notwithstanding the above, waivers of recourse, liabilities, exclusions and indemnities given under the CONTRACT shall not apply in case of WILFUL MISCONDUCT of the indemnified GROUP.
i) Whenever a PARTY or any other member of COMPANY GROUP or SUPPLIER GROUP is pursued in respect of any loss, damage, bodily injury including death, sickness or disease, then the PARTY that is liable therefore under the provisions of the CONTRACT, shall defend, indemnify and hold harmless the former.
ii) Whenever a PARTY or any other member of COMPANY GROUP or SUPPLIER GROUP is obliged or held responsible to pay, pursuant to a judgment, a sum for which the other PARTY is liable under the provisions of the CONTRACT, the latter shall reimburse and indemnify the former without delay.

3.1.9 الغير
1) يذود المُورِّدُ عن مجموعة الشركة ويعوضها ويبريء ذمتها من وإزاء أي دعوى بشأن ما يلحق بممتلكات الغير ومُعدَّاته من تلف أو خسارة، بما فيها الخسارة الاستتباعية وما تتسبب فيه مجموعة المُورِّد أو مُمتلكات مجموعة المُورِّد ومُعدَّاتها وما ينشأ عن تأدية العقد أو سؤ تأديته أو عدم تأديته أو يتعلق بهم من إصابة بدنية وشخصية بما فيها مرض الغير أياً كان أو وفاته.
2) تذود الشركة عن مجموعة المُورِّد وتعوضها وتبريء ذمتها من وإزاء أي دعوى بشأن ما يلحق ممتلكات الغير ومُعدَّاته من تلف أو خسارة، بما فيها الخسارة الاستتباعية وما تتسبب فيه مجموعة الشركة أو مُمتلكات مجموعة الشركة ومُعدَّاتها وما ينشأ عن تأدية العقد أو سؤ تأديته أو عدم تأديته أو يتعلق بهم من إصابة بدنية وشخصية بما فيها مرض الغير أياً كان أو وفاته.
2.9 التنازل عن حق الرجوع
1) إن المُورِّد يتنازل عن كافة حقوقه في الرجوع على مجموعة الشركة ويذود المُورِّدُ عن مجموعة الشركة ويعوضها ويبريء ذمتها من وإزاء أي دعوى بشأن ما يحل بممتلكات مجموعة المُورِّد ومُعداتها من خسارة أو تلف.
2) إن الشركة تتنازل، وفقاً لنصوص المادة 2.1.9، عن كافة حقوقها في الرجوع على مجموعة المُورِّد وتذودُ الشركة عن مجموعة المُورِّد وتُعوِّضها وتبريء ذمتها من وإزاء أي دعوى بشأن ما يحل بممتلكات مجموعة الشركة ومُعداتها من خسارة أو تلف.
10. إبراء الذمة
يسري ما يُقدَّم بموجب العقد من تنازلات عن حق الرجوع والاستثناءات والتعويضات أياً كان السبب وعلى الرغم من إهمال المجموعة المُعوَّضة أو إخلالها بواجبها (سواء أكان منصوص عليه قانونياً أو غيره) أو أي تقصير من أي نوع، ويُطبَّق بصرف النظر عن دعوى الإضرار أو العقد أو غيرها من المسائل القانونية. يُؤَدَّى كل ما ينشأ بمقتضى العقد من تعويضات كاملاً أصلياً ويسري بصرف النظر عن أي حق منفصل في التعويض أو المُساهمة من أي شخص مالم ينص العقد على غير ذلك. وبرغم ما تقدَّم ذكره، لا يسري ما يُقدَّم بموجب العقد من تنازلات عن حق الرجوع والمسؤوليات والاستثناءات والتعويضات حال اقتراف المجموعة المُعوَّضة سؤ تصرف مُتعَمَّد.
1) متى كان هناك طرفٌ أو أي من أعضاء مجموعة الشركة أو مجموعة المُورِّد الآخرين مُلاحقاً بشأن أي خسارة أو تلف أو إصابة بدنية بما فيها المرض أوالوفاة، يذودُ عن الأوَّلِ ويعوضه ويبريء ذمته الطرفُ المسؤولُ بموجب ما يقتضيه العقد من أحكام.
2) متى كان هناك طرفٌ أو أي من أعضاء مجموعة الشركة أو مجموعة المُورِّد الآخرين مُلزَمٌ أو عُدَّ مسؤولاً بموجب حكم قضائي عن سداد مبلغ من المال وقضت شروط العقد بمسؤولية الطرف الآخر عنه، يُعوِّضُ الأوَّلُ الثانيَ ويرُد إليه ما غرِمه دون تأخر.
