Source text - English 26. Confidentiality 26.1. Information relating to the evaluation of bids and recommendation of contract award, shall not be disclosed to bidders or any other persons not officially concerned with the bidding process until information on Contract Award is communication to all Bidders in accordance with ITB 40.
26.2 Any effort by a Bidder to influence the Purchaser in the evaluation or contract award decisions may result in the rejection of its Bid.
26.3 Notwithstanding ITB 26.2, from the time of bid opening to the time of Contract Award, if any Bidder wishes to contact the Purchaser on any matter related to the bidding process, it should do so in writing.
27. Clarification of Bids
27.1 To assist in the examination, evaluation, comparison of the bids, and qualification of the Bidders, the Purchaser may, at its discretion, ask any Bidder for a clarification of its Bid. Any clarification submitted by a Bidder in respect to its Bid and that is not in response to a request by the Purchaser shall not be considered The Purchaser’s request for clarification and the response shall be in writing. No change, including any voluntary increase or decrease, in the prices or substance of the Bid shall be sought, offered, or permitted, except to confirm the correction of arithmetic errors discovered by the Purchaser in the Evaluation of the bids, in accordance with ITB 31.
27.2 If a Bidder does not provide clarifications of its bid by the date and time set in the Purchaser’s request for clarification, its bid may be rejected.
28. Deviations, Reservations, and Omissions
28.1 During the evaluation of bids, the following definitions apply:
(a) “Deviation” is a departure from the requirements specified in the Bidding Documents;
(b) “Reservation” is the setting of limiting conditions or withholding from complete acceptance of the requirements specified in the Bidding Documents; and
(c) “Omission” is the failure to submit part or all of the information or documentation required in the Bidding Documents.

Tính bảo mật 26.1 Thông tin liên quan đến kiểm tra, đánh giá, so sánh và hậu tuyển Hồ sơ dự thầu và đề nghị trao Hợp đồng sẽ không được thông báo cho các Nhà thầu hay bất kỳ cá nhân nào không liên quan chính thức đến quá trình đấu thầu cho đến khi thông tin về trao Hợp đồng được công bố với tất cả các Nhà thầu;
26.2 Mọi cố gắng của Nhà thầu nhằm tác động đến Bên mua trong khi kiểm tra, đánh giá, so sánh và hậu tuyển Hồ sơ dự thầu hay quyết định trao Hợp đồng có thể khiến hồ sơ của Nhà thầu đó bị loại.
26.3 Trừ trường hợp qui định tại Mục 28.2 của ITB, từ lúc mở Hồ sơ dự thầu đến khi trao Hợp đồng, nếu Nhà thầu nào muốn liên hệ với Bên mua về bất cứ vấn đề nào liên quan đến quá trình đấu thầu, Nhà thầu đó có thể liên hệ bằng văn bản.
27. Giải thích Hồ sơ dự thầu 27.1 Để hỗ trợ cho việc kiểm tra, đánh giá, so sánh và hậu tuyển Hồ sơ dự thầu, Bên mua có thể yêu cầu Nhà thầu giải thích rõ thêm về Hồ sơ dự thầu của họ. Những giải thích do Nhà thầu nộp không phúc đáp những yêu cầu của Bên mua sẽ không được xem xét. Yêu cầu giải thích thêm của Bên mua và phúc đáp phải làm bằng văn bản. Không được xin, đề xuất hoặc cho phép thay đổi về giá cả hoặc nội dung của Hồ sơ dự thầu, trừ khi xác nhận sửa lỗi số học do Bên mua phát hiện ra trong khi đánh giá Hồ sơ dự thầu, theo Khoản 33 của ITB.
27.2 Nếu Nhà thầu không cung cấp phần giải thích cho Hồ sơ dự thầu của mình trong thời hạn Bên mua yêu cầu giải thích thì Hồ sơ dự thầu có thể bị loại.
28. Sai lệch, hạn chế và thiếu sót 28.1 Trong quá trình xét thầu, các định nghĩa sau được áp dụng:
(a) “Sai lệch” là sai khác so với yêu cầu trong Hồ sơ mời thầu;
(b) “Hạn chế” là tình trạng thiếu các điều kiện hoặc từ chối chấp nhận hoàn toàn các yêu cầu trong Hồ sơ mời thầu; và
(c) “Thiếu sót” là không nộp một phần thông tin hoặc tài liệu theo yêu cầu của Hồ sơ mời thầu.
