Contemporary opinions about sexual desire, and especially about its lawfulness outside marriage, were overwhelmingly articulated by men (or through them, in their capacity as scribes and authors). When such views were expressed publicly it was normally in facetious form – in 1631, for example, the king’s printer Robert Barker got into terrible trouble when his employees produced an edition of the Bible in which the word ‘not’ was omitted from the seventh commandment. (That this was no innocent typo can be seen from the rendering in another verse of ‘God’s greatnesse’ as ‘God’s great asse’.)
More usually, however, they were uttered privately – especially in response to the threat of punishment. When Miles Horne and Elizabeth Powell were arrested and brought to Bridewell in May 1576 for having sex in a Southwark tavern, for example, they responded simply ‘that they about it were taken afore they were done’. A peasant in early seventeenth-century Somerset was equally matter-of-fact upon being surprised in the act with his lover and being told ‘that they must look to be punished for what they had done’. ‘Did you never see a cow bulled before?’ he retorted.

Mais comum, no entanto, era que elas fossem expressas em caráter privado — principalmente como reação à ameaça de punição. Não só entre uma fase e outra de seu percurso filosófico que Foucault apresenta diferentes teses sobre a teoria e a prática psicanalítica, mas no interior de um mesmo livro encontramos formulações ambíguas sobre o assunto. Tendo como pano de fundo os diversos comentários dissonantes do autor sobre a psicanálise, trata-se de pensar de que modo os escritos da década de 70, em particular, se relacionam com a crítica foucaultiana das ciências humanas sistematizada em 66, em "As palavras e as coisas". Visto que neste livro o filósofo condena certo tipo de reflexão que procura conferir um estatuto ontológico à finitude humana (ou seja, fazer ontologia do ser constitutivamente alienado do homem), faz-se necessário investigar se a crítica que Foucault endereça à psicanálise depois de 66 se dá nos mesmos termos que a crítica feita às analíticas da finitude.
Trata-se, então, de entender se a acusação de que a psicanálise não passa de mais um “dispositivo de sexualidade” a serviço do biopoder está fundada na ideia de que a psicanálise supõe uma ontologia. A ideia da psicanálise como ontologia, contudo, é uma tese recusada por Foucault em alguns escritos da década de 50 e 60. Neste período, o filósofo defende que a psicanálise é antes de tudo um método hermenêutico e não uma teoria geral sobre o homem. Assim, se é verdade que as teses genealógicas finais de Foucault sobre a psicanálise fundamentam-se na visão da psicanálise como ontologia, deparamo-nos com um problema: afinal, a psicanálise, para Foucault, consiste ou não numa teoria sobre o ser do homem?

(…) Not only does Foucault pose different theses on psychoanalytical theory and practice in different phases of his philosophical itinerary, but within the same book we find ambiguous formulations on the subject. Having as a background the author’s several dissonant comments on psychoanalysis, our intent is to consider in which ways particularly the texts from the 1970’s relate to Foucault’s critique of human sciences that was systematized in 1966 in "The Order of Things". Given that, in this book, the philosopher condemns a certain kind of reflection that aims to confer an ontological status on human finitude (i.e. to develop an ontology of man’s constitutively alienated being), it is necessary to investigate whether the critique that Foucault addresses to psychoanalysis after 1966 is framed along the same lines as the critique made to the analytics of finitude.
The aim is, therefore, to understand whether or not the accusatory claim that psychoanalysis is nothing but a “sexuality device” at the service of biopower is founded on the idea that psychoanalysis presupposes an ontology. The idea of psychoanalysis as ontology, however, is a thesis that is refuted by Foucault in some texts from the 1950’s and 1960’s. In this period, the philosopher holds that psychoanalysis is, above all, rather a hermeneutic method than a general theory on man. Thus, if it is true that Foucault’s final genealogical theses on psychoanalysis are grounded on a view of psychoanalysis as ontology, we are posed with a problem: does psychoanalysis ultimately consist, for Foucault, in a theory on the being of man?
