5 HAZARDOUS SUBSTANCES AND/OR MATERIALS
The Customer represents and warrants that it has informed KONE, and the Customer covenants that it shall keep KONE informed, about any and all hazardous substances, any hindrances and/or materials, including without limitation asbestos, associated with the equipment to be dismantled by KONE and/or existing or discovered in the premises in which KONE’s works shall be provided and/or the equipment shall be installed. In case such hazardous substances and/or materials or any hindrances are found or discovered in the course of or relating to KONE’s works, KONE shall be entitled to suspend its works until the Customer has removed or appropriately contained the hazardous substances and/or materials and KONE shall be entitled to a corresponding extension to its time for completion. Notwithstanding clause 6 above the ownership and title to any hazardous substances and/or materials or any hindrances and to components containing such substances or materials shall always remain vested in the Customer.
