3. In consideration of the performance of the Subcontract works carried out/to be thru Bill of Quantities as per Construction Drawings, other Engineering Deliverables and all other additional works executed so far or will be executed for the purpose to meet the intended Project design requirements including but limited to; Site Instructions (up to 31 May 2021), any written instruction including TDR up to 31 May 2021, both parties have amicably agreed, in a spirit of cooperation, to fully and irrevocably Amend the Subcontract Value for Civil Works in on plot Area (ISBL) and Asphalt works in Main Access Roads (OSBL) keeping all other terms and conditions stated in various sections of the Subcontract Agreement (JI-2035/27- 002) as unaltered, The Final Subcontract Amount for the Subcontract is KWD 21,500,000 (Kuwait Dinars Twenty One Million Five Hundred Thousand only) and it is explicitly stated in Attachment 1 which represents the full and final settlement towards the execution and completion of all works and remedying the defects therein as per the AFC & RLM drawings listed in the attached Technical Document Register (TDR) until 31 May 2021, and including the works already executed and agreed in Area 1 by the Subcontractor, All additional works including Hard rocks excavation, Site Instructions up to 31 May 2021, Full and Final compensation due to descoping of Area 1 works from the Original Subcontract Value etc.
