"It was understood that direct or indirect reproduction includes, among other things, reproduction by means of: (a) moulding and casting; (b) recording the sounds produced by playing a pre-existent phonogram; and (c) recording off the air a broadcast of the sounds produced by playing a phonogram".

I'm not sure of the meaning of 'recording off the air'. Any help would be appreciated.

recording directly from the broadcast sound


That means, you play the phonogram, and the device will listen to the sound it produces and record.

So, there is no (cable) connection between the sound recording device and the sound producing device.
