subrogated rights

subrogation; to put in place of another party as successor to that party\'s rights

In the context of this site, the person from whom a vehicle is stolen is the \'victim\' or \'loser\'; they suffer a financial loss (in addition to inconvenience etc.) until they are paid out by their Insurance company. By making settlement to their Insured, the Insurer takes on the loss (it is the Insurer who is now \'out of pocket\' and suffers the financial loss) and acquires the rights of the loser; their Insured. In effect, the Insurer steps into the shoes of their Insured and acquires their right to pursue, for example, recovery of the payment.
