Spanish term

Juicio de Ponderación

Spanish to English Law/Patents Law (general) Pre-trial detention
Any kindly lawyers awake out there?

I need a good English equivalent for this legal term from Spain
Literally in my text it refers to the decision when the judge weighs up the factors to determine whether or not to decree pre-trial detention. The meaning is clear, but "weighting judgement" is less than convincing

Here is another example:
Es decir, se trata de un criterio que expresa una ponderación de todos los intereses jurídico-penalmente relevantes, juicio de ponderación en el que, ...
Thanks in advance.

Discussion

Richard Boulter Mar 31, 2010:
After a refreshing night's sleep... Upon review of the text provided in the Query, I heartily agree with Lucia and Antonio that this is probably not referring to a 'court proceeding' in this context. Rather, it's talking about the judge's mental processing of the information that has been presented, perhaps in the 'informacion' phase of some proceeding. It could include the 'mental decision' without including the official pronouncement of that decision in court. Good eye for the intended meaning, my dear colleagues. Regards, All!

assessment and weighting of

This is not a purely legal phrase as 'juicio' does not entail here a 'finding' or 'order' as such, but a mere opinion, on which a ruling or order may eventually be based.

finding of probable cause / bind over for trial

In the query, this sounds very much like the point in an 'arraignment' where the judge decides that the prosecution has shown enough evidence of 'probable cause / motivo fundado' to justify holding the defendant and scheduling the trial, which is to 'bind the defendant over for trial'. He remains in jail unless he posts a bail or bond.
You can see if this fits your context and the procedure under Spanish law. From this point, other pre-trial hearings and processes can begin, leading up to the trial, itself.

Hola, Patrick:
No sé si soy kindly ni si estoy despierta, pero para empezar, te pongo lo que dice acá:
"appraisal, assessment, consideration, wighting (?)
evaluate, with [up], consider, ponder, assess, examine"

¿Si usaras "assess"?

Voy a buscar un poco más y vuelvo. Saludos!

Es interesante que la frase "the judge must weigh" se usa mucho, fijate en sangugel y lo verás.

Hasta mañana, suerte.
